The Arbitration Office - Out-of-court dispute resolution - "Mediation instead of judgment"
In the event of a dispute, there is always the option of going to the state courts. However, there is also the option of settling the dispute outside of court before an independent arbitration board. An impartial, experienced third party mediates the dispute, taking into account all the relevant circumstances of the conflict. In this way, solutions to disputes can be found more quickly, cost-effectively and with less bureaucracy than in court proceedings. The personal or business relationships of the disputing parties are often less strained.
Certain civil law disputes can only be referred to the court if it can be proven that no agreement has been reached in a previous dispute resolution (compulsory dispute resolution).
These include
- certain disputes under neighboring law,
- disputes due to violation of personal honor with the exception of defamation in the press and broadcasting
The private prosecution offenses (criminal disputes) that require mandatory arbitration include
- Insult
- Assault
- Damage to property
- Trespass
- Threat
- Breach of the secrecy of correspondence
In many other cases, voluntary (optional) dispute resolution is of course also possible.
